- Point 3.4 of Annex I to Regulation 2023/915 on maximum levels for certain contaminants in foodstuffs, for the parameter inorganic arsenic in baby foods (3), we are referred to Article 2(f) of Regulation (EU) No. 609/2013 of the European Parliament and of the Council of June 12, 2013, on food intended for infants and young children, food for special medical purposes, and total diet replacement for weight control, where Article 2(f) defines “baby foods” are defined as: foods intended to meet the particular nutritional needs of healthy infants during weaning and healthy young children as a supplement to their diet or for their gradual adaptation to a normal diet, with the exception of 1) foods based on cereals, and 2) milk-based drinks and similar products intended for young children. According to the definition of infant foods given in Regulation 609/2013, for foods made from cereals, the value of 0.020 ppm for inorganic arsenic would not apply. In this case, Regulation 2023/915 in Annex I point 3.4.1.5, for rice intended for the production of food for infants and young children, considers the value of 0.10 mg/kg, and has not considered the inclusion of the specific category of foods made from cereals. Therefore, for the calculation of the maximum limit for this type of product, Article 3 of Regulation 2023/915 (dried, diluted, processed, and compound foods) would apply and, given that the product “rice cream” is composed of 99.9% rice, the maximum limit to be applied for inorganic arsenic would be 0.099 mg/kg. According to the analysis report provided, the inorganic arsenic value obtained in the sample was 0.081 mg/kg, which is below the maximum limit allowed for this product category. In view of the above information, it is considered that this product is fit for human consumption and the notification is requested to be withdrawn.
