An online investigation was initiated following a consumer complaint. The Dutch operator offers multiple food supplements containing CBD, CBG or CBN for sale. The products include, among others, CBD oils, CBD capsules and CBD gummies intended for oral consumption. Currently, only hemp seed and some of its derivatives (e.g. hemp seed oil) have a proven history of consumption as a food before 15 May 1997 in the European Union. But no significant history as a food ingredient has yet been demonstrated for hemp extracts and CBD extracts. They are thus considered unauthorized novel foods and are consequently not allowed to be marketed in the EU. In addition, EFSA has given a provisional safe level for cannabidiol as novel food, which is approx. 2 mg/day for a 70 kg adult, excluding individuals under 25 years old, pregnant and lactating women, and those on medication. The CBD products sold in the webshop contain CBD in amounts exceeding this provisional safe level, and thus pose also a potential health risk.
