Cannabinoids, especially synthetically derived cannabinoids, are considered to be considered novel. The single substance HHC, a cannabinoid, is considered a novel food. Extracts of Cannabis sativa and other products thereof containing cannabinoids are considered novel foods as there is no documented history of use for these products. According to Regulation (EU) 2017/2470, neither extracts of Cannabis sativa containing (possibly) cannabinoids (here HHC), nor extracts and/or pastes from flowers, leaves or stems, nor the cannabinoid HHC itself, are included in the Union list of novel foods. The products found or the HHC contained therein are therefore a non-authorised novel food within the meaning of Article 3(2a) of Regulation (EU) 2015/2283.
