Additive E476 is only allowed in cocoa-based confectionery. The coverage in which the additive is found does not have any cocoa content, so its use was not allowed in this type of product. However, the biscuit it covers does present 2% cocoa. According to Royal Decree 823/1990: it defines cocoa-based confectionery as preparation of variable shape and composition with a minimum content of 10% of chocolate and / or chocolate toppings. It cannot apply the transfer principle of article 18 of the regulation and suppose that the additive came from the utterly hydrogenated fat (palm) that is part of the white substitute since the use of this additive was allowed only in fats for spreading, and this fat cannot be classified in this type of product.
