- According to the declaration, the sample contains the ingredients N-acetyl L-tyrosine, dimethylaminoethanol (DMAE) and L-alpha-glycerylphosphorylcholine (alpha GPC). No information could be identified on the use of these substances in significant quantities as foods or food ingredients before May 15, 1997, so that they are novel foods or food ingredients according to Art. 3(2)(a)(iv) of Regulation (EU) 2015/2283. According to Article 6(2) of Regulation (EU) 2015/2283, only approved novel foods included in the Union list may be placed on the market as such or used in and on foods in accordance with the conditions and labelling requirements laid down in the list. This Union list can be found in the Annex to the DVO (EU) 2017/2470, and the substances N-acetyl L-tyrosine, dimethyl amino ethanol (DMAE) and alpha GPC are not included in this list. Therefore, the investigated product does not comply with the requirements of Regulation (EU) No 2015/2283.
