Benzoic acid is a permitted preservative, the concentration of which in soft drinks is controlled by 1333/2008 on food additives enabled by the Food Additives, Flavourings, Enzymes and Extraction Solvents (England) Regulations 2013. A product of this description is required to contain a maximum of 150 milligrams per kilogram of benzoic acid. The sample contained an excess of benzoic acid (430 mg/kg), contrary to the requirements of the Regulations and was therefore unsatisfactory.
