Unofficial translation: 1) In samples of various flavours, danthrone was detected at content levels between 483 +/- 96.5 mg/kg and 585 +/- 117 mg/kg. Based on the classification as a prohibited foodstuff in accordance with Annex III Part A of Regulation (EC) No 1925/2006 due to the detected carcinogenic properties of whole leaf aloe extract and danthron, foodstuffs containing these substances are to be considered harmful to health. The present sample is therefore an unsafe foodstuff within the meaning of Article 14(2)(a) of Regulation (EC) No 178/2002. According to Article 14(1) of Regulation (EC) No 178/2002, foodstuffs that are unsafe may not be placed on the market. 2) Furthermore, the use of senna leaves constitutes a violation of Article 6(2) of Regulation (EU) 2015/2283, as it is a novel food that has not been authorised.

    The validation for the measurement of danthron was not suitable for determining the substance quantitatively. The result for danthron was determined to be a false positive. The expert reports were revised at the CVUA-RRW and resubmitted. The complaint that the four types of tea are harmful to health within the meaning of Article 14(2)(a) of Regulation (EC) No 178/2002 is no longer applicable in the new assessment. The original notification is withdrawn.
