Cannabinoids, especially synthetically obtained cannabinoids, are considered as novel (literally, the Novel Food Catalogue states: Synthetically obtained cannabinoids are considered as novel). The single substance HHC, a cannabinoid, is considered a novel food. Extracts from Cannabis sativa and other products thereof that contain cannabinoids are considered novel foods, as there is no documented history of consumption for such products. According to Regulation (EU) 2017/2470, neither extracts from Cannabis sativa that (may) contain cannabinoids (here HHC), nor extracts and/or pastes from flowers, leaves or stems, nor the cannabinoid HHC itself are included in the Union list of novel foods. The products found or the HHC contained therein is therefore a non-authorised novel food within the meaning of Art. 3 para. 2a Regulation (EU) 2015/2283.
